Terms of this Agreement

This Agreement between you and Eurobanco Bank Ltd. ("Eurobanco", "the Bank"), governs the use of Eurobanco On Line, an electronic service that permits Eurobanco customers to access account information and financial services through the use of personal computers, mobile devices, and others devices of similar access. In this Agreement, the words "you" and "your" refer to the account holder(s) and its authorized signatories.

Account Access

Account(s) to be accessed through Eurobanco On Line will include all accounts listed on your Eurobanco Customer Profile. In order to link different accounts, you must be a signatory of these accounts.

Lost Password

You agree to keep your password safe and, in the event that you are a business customer given the facility to nominate persons authorized to access your accounts, you will ensure that all such authorized users keep their passwords safe and that you and all authorized users will not share the same with anyone. If you suspect that your password or the password of an authorized user has been compromised or that your account(s) has been or may be accessed by an unauthorized party(ies), you acknowledge that you are obliged to email immediately to customersupport@eurobancobankltd.com.

Security Procedures

You acknowledge that you will protect access to your accounts and information on your personal computer and mobile devices.

While we take strong measures to ensure the security of your financial transactions and the confidentiality of your information, it is extremely important that you also take precautions to ensure that your information remains safe and secure.

Changes in Services / Terms

The Bank may change the Eurobanco On Line services and the terms set forth in this Agreement at any time. You will be notified of any such change as required by applicable law, and we will need to be formally informed about your acceptance or denial with them.

Suspension / Cancellation of Eurobanco On Line

You may cancel this Agreement at any time by written notification to the Bank. The Bank shall have the right in its sole discretion to (i) limit your use of Eurobanco On Line; (ii) suspend your use of Internet Banking, or (iii) terminate your use of Eurobanco On Line and cancel this Agreement, for any reason, at any time.

Confidentiality at Eurobanco

You have a right to confidentiality and financial privacy provided always that the Bank may disclose any information about you and your accounts:

a. pursuant to legal process or subpoena, or

b. if disclosure is necessary to protect the Bank's interests.

Limit of Liability

The Bank agrees to make reasonable efforts to ensure full performance of Eurobanco On Line.

Any information you receive from the Bank is believed to be reliable. However, it can only be provided on a best effort basis for your convenience and is not guaranteed. The Bank is not liable for any deficiencies in the accuracy, completeness, availability or timeliness of such information or for any investment or other decision made using this information.

The Bank is not responsible for system disruptions including disruptions caused by any computer virus or related problems.

Neither the Bank, nor any other information provider, makes any express or implied warranties concerning Internet Banking software or services or browsers including, but not limited to, any warranties of merchantability, fitness for a particular purpose or non-infringement of third party proprietary rights unless disclaiming such warranties is prohibited by law.

Prohibitions on Use

You will not: (i) access or use the Services for an illegal, fraudulent or defamatory purpose, or (ii) take steps or actions that could or do undermine the security, integrity, effectiveness, goodwill or connectivity of the Services (including but not limited to fraudulent, malicious or other activities that threaten to harm or cause harm to any other person). You expressly authorize and instruct the bank to suspend your use of Eurobanco On Line and without prior notice, when it has been deemed that the use of Eurobanco On Line may infringe any of the aforementioned prohibitions on use.

Authorized Users

For business customers, Internet banking access to account information and financial services will be made available to those persons who are authorized to access the account by means of their own personal and individual login and password identification. You agree to assume full responsibility for any and all actions taken by an authorized user. You agree and acknowledge that your personal login information and password is not to be shared, divulged, or disclosed to anyone and that the authorized users will only access your account information and financial services by means of login identification and password assigned to that particular authorized user.

Security

Access to Eurobanco On Line is by means of an Eurobanco password unique to you. You must transmit your password correctly to use Eurobanco On Line.

Data Transmission and Storage

Your Eurobanco On Line data, which includes instructions by you to access your accounts, and your access codes or other means of gaining access to your accounts and other personal information, will be secured between the Eurobanco computer and the Eurobanco service provider's Internet Server. Eurobanco will not assume liability for your data on route from the computer you use to perform Eurobanco On Line to the Eurobanco computer and from that computer to the computer you use to perform Eurobanco On Line. You authorize us to collect from you, use and distribute to Eurobanco's service providers in and outside of Bahamas, for their collection, use and distribution, your data for the purpose of providing the Eurobanco On Line services to you. You authorize us and our service providers to store your Eurobanco On Line data in an out-of-country Internet Server.

Indemnification

You agree to indemnify and hold harmless the Bank, its associates, subsidiaries and affiliates and their officers, directors, employees and agents, all third party suppliers and their respective officers, directors, employees and agents, from and against any and all liabilities, damages, awards, settlements, losses, claims and expenses, including reasonable attorney's fees and expenses and costs of investigation (collectively, "Damages") resulting from third party claims to the extent such claims, if brought by you directly against Eurobanco.

Severability

In the event anyone or more of the provisions of this Agreement shall, for any reason, be held to be invalid, illegal or unenforceable, the remaining provisions shall remain valid and enforceable.

Notices

Notices to the Bank shall be in writing and sent to: Eurobanco (Bahamas) Caves professional Centre, Suite 5, West Bay Street & Blake Road, Nassau, Bahamas. Notices to you shall be issued in writing to your address on record or otherwise as provided herein.

Governing Law

This Agreement shall be governed by the laws of the Bahamas.
